Raising the Age of Criminal Responsibility with Cross County Departments

The Enacted Budget includes legislation for Raising the Age for Criminal Responsibility from 16 to 18 years of age and establish services necessary.  The new measures will be phased in over time, raising the age of juvenile delinquency from age 16- to 17-years-old beginning on October 1, 2018, and subsequently raising the age of criminal responsibility to 18-years-old on October 1, 2019.
 
The new law has the potential to affect several county departments, and is likely to require additional personnel in probation departments, county attorney's offices, mental health services, and social service agencies. It will also require county investments in court facilities and youth detention or local correctional facilities.  Counties that adhere to the state-imposed property tax cap will be eligible for full reimbursement for the added costs resulting from raising the age of criminal responsibility.  Counties that exceed the property tax cap may still be eligible for full or partial reimbursement if they are granted a waiver by the Director of the State Division of Budget.
