NYSAC Funding Indigent Legal Defense Services in NYS
According to the New York State Office of Indigent Legal Services (ILS):
· Local taxpayers from the 57 counties and City of New York spend over $360 million per year on indigent legal services.
· The 57 counties outside of NYC fund $155 million annually on public defense.
· The state provides the 57 counties with $39 million (¼ of the costs) in indigent defense support.
· New York City spends $215 million locally on this program and receives $44 million from the state to provide indigent defense services and $40 million from the Office of Court Administration to cover expanded first arraignment and case caps.
Recently passed legislation (S.8114/A.10706) provides for a 7-year state takeover of the costs of indigent legal defense services. The measure now awaits approval of Governor Andrew Cuomo.
